In a notable legal development, Gillio Lopes, one of the seven men implicated in a sexual assault lawsuit at Cornell University, is challenging the appointment of New York Attorney General Letitia James as the special prosecutor for the case. Lopes’ legal representative argues that James has displayed a clear bias against the defendants, undermining the integrity of the investigation.

On Wednesday, Lopes’ attorney submitted a petition to the Albany County Supreme Court, asserting that James has “unequivocally demonstrated a bias and presumption of guilt” towards the individuals named in the civil lawsuit filed by a former Cornell student. The lawsuit alleges that the student was intoxicated and sexually assaulted at the Chi Phi fraternity house in October 2024.

James, recently appointed by Governor Kathy Hochul to independently investigate the allegations, is tasked with evaluating whether there is sufficient evidence to pursue criminal charges. The petition filed against her asserts that her public statements about the case compromise her ability to conduct an unbiased investigation.

As part of the legal proceedings, Lopes’ petition seeks to annul or modify James’ appointment, expressing concerns over her ability to lead the investigation impartially. In a statement, Lopes’ attorney emphasized the necessity for public confidence in the investigation’s leadership, citing James’ previous comments as a source of concern.

Hochul appointed James after expressing dissatisfaction with the initial handling of the case by the Tompkins County District Attorney, who had previously deemed the evidence insufficient for criminal charges. In response to Lopes’ challenge, James’ office has declined to comment on the matter specifically, but she has reiterated her commitment to a thorough investigation guided by facts and evidence.

The ongoing legal battle follows a significant response from the Cornell community, where the fraternity involved has been suspended and barred from campus activities. The civil suit has garnered national attention, raising critical discussions about sexual assault on college campuses.

As the situation unfolds, Lopes maintains his innocence, and his legal team continues to contest the allegations made against him and the other defendants. This case not only highlights the complexities of legal proceedings in sexual assault cases but also raises questions about the dynamics of due process and public perception.
