Justice Elena Kagan has issued a strong critique of the Supreme Court’s conservative majority, warning that its recent decisions threaten the foundations of democracy. Speaking at Catholic University of America, Kagan highlighted various rulings, including those that have enabled extensive partisan gerrymandering and weakened protections for minority voters.

In her address, Kagan expressed her concern over the court’s lack of awareness regarding the “deleterious effects” their decisions have on the political landscape. “The court has blinded itself to the very negative consequences of their rulings,” she stated, asserting that these actions have contributed to a dysfunctional democracy.

Kagan specifically referenced a 2019 Supreme Court ruling that barred federal courts from intervening in cases of extreme partisan gerrymandering. She noted that this has led to a race among states to draw maps that favor the ruling party, effectively diminishing competition in elections. Additionally, Kagan criticized the court’s recent decisions that have dismantled crucial aspects of the Voting Rights Act, allowing states to curtail minority voting rights.

As the upcoming midterm elections approach, Kagan warned that the current trend of redistricting is exacerbating political polarization, pushing candidates towards more extreme positions due to the safe nature of their districts. “When states draw legislative districts that almost eliminate the ability of many voters to elect their preferred candidates, it is profoundly damaging to our democracy,” she remarked.

Kagan also tackled the influence of money in politics, asserting that many Americans view the current landscape as a troubling nightmare. She cautioned against the dangers of excessive presidential power, referring to a recent ruling that expanded Trump’s control over independent federal agencies.

Despite her critical stance, Kagan defended the court’s independence, pointing out instances where the conservative majority has ruled against the Trump administration. She acknowledged the court’s conservative tilt but emphasized that it has, in certain cases, pushed back against presidential overreach.
