In a notable legal battle, former FBI Director James Comey is asking a court to dismiss what he claims is an invalid criminal case brought against him by the Trump administration. This case marks the third attempt to prosecute Comey in the span of just over a year, reflecting a pattern of legal action that many see as politically motivated.

Comey has been under scrutiny since his dismissal by Donald Trump nearly a decade ago. The current charges stem from incidents dating back to 2016 and involve allegations that he authorized staff to communicate with a reporter for The New York Times regarding classified information. However, Comey’s legal team argues that the case lacks merit because it was not presented to a federal grand jury before the expiration of the ten-year statute of limitations.

Previously, Comey faced two other indictments since September 2025, both of which were controversial. The first case was dismissed after it was revealed that a Trump-aligned attorney had acted unlawfully in procuring the indictment. The second case, concerning an Instagram photo featuring seashells, has also been challenged by Comey’s attorneys who assert that it was misinterpreted as a threat.

The latest legal maneuvering involves an indictment filed under seal on October 5, coincidentally the tenth anniversary of a significant news story involving Yahoo’s compliance with a secret court order. Notably, the method by which the current case was initiated—a criminal information filed without judge approval—has raised eyebrows among legal experts, who question its legitimacy.

Sarah Krissoff, a former federal prosecutor, expressed concern about the Justice Department’s approach, criticizing the lack of due process in obtaining the indictment. She described the situation as “disturbing,” indicating that the case likely lacks a solid foundation.

The upcoming hearing set by U.S. District Judge Trevor McFadden will determine the fate of Comey’s motion to dismiss the case. This legal showdown unfolds amid a broader context of federal inquiries that have seen various individuals affiliated with the Trump administration facing scrutiny and legal challenges.
